The European Commission decided to take Spain to the Court of Justice for not implementing data protection regulations.

This is because Spain has not notified the adaptation of measures to incorporate the data protection directive in the criminal field. By not communicating this information to the European Commission, Spain has failed to fulfill the obligations of the directive.

Data protection is a fundamental right of individuals. The aim of the directives established by the European Union is to guarantee this security, for the purposes of preventing, detecting and investigating legal violations.

La forma de actuar de España ha creado un nivel de protección diferente al obstaculizar el intercambio de datos entre España y los estados miembros que sí traspasarán esta directiva.

La Comisión ha pedido al Tribunal una multa de 5.290.000€ y una multa de 21.321€ por día transcurrido entre el vencimiento de la fecha límite para aplicar estas directivas y el día de cumplimiento por parte de España, esta ascendería a 89.548,20 €.
